When a customer purchases a product from Noah Garden Rooms, the customer is agreeing to the
terms and conditions as set out below. Customers are advised to read the following terms and
conditions carefully.
Our terms and conditions do not affect your statutory rights.
Our details and contact.
Our contact details are available on our website: - www.noahgardenrooms.co.uk Telephone calls to
and from our office are recorded. When payments are made over the telephone, we will put you on
a secure line which is not recorded.
Placing your order.
Please note that most of our buildings do not require Permitted Develop checks with your local
council. Our standard buildings are produced to a maximum height of 2.5m which does not require
Permitted Development checks if on flat level ground. If your building base is elevated or you have a
Canopy roof as part of your building it is your responsibility to check with your local council to see if
this falls into Permitted Development or not, UK garden rooms Ltd T/A Noah garden rooms are not
responsible for this check or any issues that arise if you have not contacted your local council. As a
guide a building can, be a maximum of 2.5m from the ground if within 2m of a boundary and 3m
from the ground if more than 2m from a border. A dual pitched roof can go up to a maximum of 4m
if more than 2m from a boundary. In both cases the maximum eaves height is 2.5m from the ground.
Any building Larger than 30m2 will require planning permission. The building cannot take up more
than 50% of the curtilage (Garden area) this includes any other outbuilding present. Please notice
this guide applies to England only should you live in Wales or Scotland please check with your local
authority.
When placing an order, we will send a confirmation of order to you which will confirm all the details
of your building. You have 14 days from placing the order to make any amendments to the order. It
is the customers responsibility to check that the details including cost, measurements and
specifications are correct. These are usually sent via email but can be sent out in the post upon
request. All buildings are made to order. If your building is of a different layout than that shown on
the website, we will ask you to send us a sketch of your building. If you wish to have windows or
doors in specific places, we need to have clear measurements on the drawing to avoid any
confusion. Otherwise, we will place these on the building where we deem best based upon your
drawing or description. We will also give you an estimated delivery date at the point of ordering.
Around 4 weeks prior to the estimated date given, we will confirm a specific date that we intend to
delivery you’re building to you. We will give our best efforts to get the delivery to you on the
delivery date given. If for some reason we cannot make this date due to extreme circumstances (for
example, breakdowns, strikes, material shortages, sickness or other factors beyond our control), you
will be informed either before or on the date of delivery at the earliest time and a new delivery date
will be given. There will be no compensation due should we be unable to attend for one of these
factors.
All our pricing and charges include VAT.
We request a 25% deposit at the point of order. 10% of your buildings total cost is a non-refundable
deposit. Any upgrades that are ordered for your building are also non-refundable as these are
purchased specifically for your building. These would be charged for should you subsequently wish
to remove them at a later point.
Cancellation period and fees
At least 21 days’ notice for postponement or cancellation is required for any buildings without
upgrades. If the 21 days is not met, we have the right to charge a fee which could be up to the total
amount of the building. If you place and confirm your order within the 21-day period, you will
automatically fall within this period and will be charged a fee should you postpone or cancel after
agreeing the date. If your building does have upgrades and you have agreed the order, the cost of
items purchased for your item will be charged even if you cancel before the 21 days as some items
must be ordered more than 3 weeks in advance.
If you change from fitting to delivery only or collection within the 21-day period, we would not
refund any fitting charge to you.
If you cancel your order before the 21-day period, your cancellation fee would be 10% of your
buildings standard cost plus the price of any upgrades that have been ordered for your building.
IMPORTANT INFORMATION – Before we arrive – Base preparation and access
Erection of your building can only take place if the base provided by yourself is, solid, absolutely
level and of sufficient size. We would not class gravel or hardcore that moves as solid. The base
should be the exact size of the building. If the base is bigger, then you may need to lay a damp-proof
membrane or do works around the bottom of the building to stop water ingress through the floor.
Any base must also be sufficiently hard for our team to work upon. If you are laying a concrete base,
then we would suggest that this is at least 4” to 6” in depth. We also recommend that it is given at
least 7 days to harden before any installation of your building starts.
The bearers to our floors usually run the length of the building. Therefore, if you are laying a timber
framed base, you need to run your bearers the width of the building. In order to ensure that your
floor sections are supported, if you are doing a timber framed base, please contact the office to
confirm the floorplan so you know where supports are required. If possible, it would be helpful to
also have a few spare bearers available should additional supports need to be added where our floor
sections meet. If you are doing a timber framed base, we strongly recommend 4”x2” timbers as a
minimum. Please contact the office if you need any additional advice on this.
We are not responsible for checking the level of the base in full and some small discrepancies may
be unnoticed at the time of installation. If you have any queries with regards to your base, please
contact the office at the earliest convenience.
In order for us to supply and install a ground screw base that you have purchased from us, please
refer to the terms and conditions of the ground screw base purchase.
In the event of the base/ground not being suitable, our fitters will stack the units on your property.
Our fitters will not be able to wait if rectifications are required on site. It is your responsibility to
correct the base, and we will return on our next available date to complete the erection. There will
be an additional charge should we need to re-attend to erect the building – please refer to our
additional costs section. We are unable to wait onsite for you to amend an insufficient base.
Access to the site will be provided by the customer. We always deliver with a 3.5-ton flatbed and on
occasion may use a trailer as well. The customer must consider whether the access to the property
(i.e. width of the road) is sufficient. We will not drive our vehicles over fields in order to get to an
access point.
We require 8 ft height access and 3 ft width to get to your base. If you are requiring the product to
go through at an angle (because 8ft in height is unavailable), then the height access for the diagonal
from corner to corner would need to be at least 8ft 3” to allow for the thickness of the panel. The
access should be clear of any obstacles. Under no circumstances will our buildings be carried over
walls, garage roofs, fences, hedges, etc. Some panels and buildings are of a large size, so you also
need to consider sharp corners, steps, banks etc. We will not carry your building up or down steps
unless this is previously agreed with the office via email/recorded telephone call. We also will not
carry panels through a house or garage. We allow 30 minutes for you to carry panels through your
house or any obstacles and we recommend you having 2 to 4 people on site to assist with this. We
can make panels smaller if required which we charge a fee for. Please also consider the distance
from the delivery vehicle to where the building is being erected due to the weight of the panels. We
would consider an average carry (distance from the vehicle to the base) to be 100ft. If your carry is
longer than this, please contact our office so that we can discuss options with you.
Please also consider the dimensions of the building when ordering including roof overhang. Roof
overhangs are additional to the overall size of the building to allow for water run off. We require a
minimum of 8ft access to your base and 1ft around the base for construction. Our teams would also
require access on top of the building to attach the roof coverings and so consideration should also
be given for overhanging trees/branches etc.
The customer must advise us if there are any access difficulties. There is only a certain amount of
time allocated to each job, so it is important that these are considered before the day. If you are
unsure about any potential access problems, please contact the office to discuss. The office will
always advise where possible. We will request photographs and measurements to be sent via email
to info@noahgardenrooms.co.uk to be able to give you approval.
We take no responsibility for any onsite inaccuracies that are beyond our control. Inadequate
groundworks, insufficient access requirements or any obstructions that arise on site will incur
additional penalties as per our additional costs section. Payment in full upon arrival will be required
for the building you have requested.
If delivery only is chosen it will be to the curb side only. You will require at least two people to
accept the building and to take it into your property.
If a customer chooses to collect their building, it is the customers responsibility to bring a sufficient
vehicle which can take the size and weight of the panels. The customer (or courier company they
choose) will require two people to load the panels onto their vehicles. If the customer does not send
two people who are able to load the building, we reserve the right to refuse the collection. We may
be able to offer assistance on the day if we have staff available to do so but this is at a cost of £120
per person required. If we do not have staff available to assist, then you would need to rearrange
your collection for another date.
We are not obliged to check any planning permission within your area. The onus is on the customer
to have this confirmed prior to any ordering process.
Delivery and installation
Delivery is arranged for convenience of the company in agreement with the customer. We as a
company operate throughout England and Wales and it can be difficult to give an accurate time to
when the building would be delivered and fitted to you. In order to attempt better customer service
than most of our competitors, an estimated time will be given when asked and our fitters, if
possible, will give a courtesy call to give notice of arrival. Although an estimated time and date is
given, we cannot guarantee this time slot as delays are occasionally inevitable due to unforeseen
circumstances which are beyond our control. We would not be liable for any delay or failure to
delivery on the estimated date.
Customers will need to make sure that someone is present to accept delivery of the building. It is the
customers’ responsibility to ensure that arrangements for delivery of the building is made. In the
event of the customer failing to keep arrangements, which makes delivery impossible, we reserve
the right to charge a fee to return to put up the building and there is no discount due if you
subsequently choose to put it up yourself.
Once the building installation has started, we will not be able to reposition your building anywhere
else so please make sure that you identify the required location in the first instance.
We will not take responsibility for accidental damage to your property caused during the
delivery/fitting process.
If delivery only is chosen it will be to the curb side only. You will require at least two people to
accept the building and to take it into your property.
In the event that a customer chooses to collect or arrange their own courier – it is the responsibility
of the customer and/or the courier company to check each panel of the building before loading onto
their vehicle. We accept no responsibility for any items damaged in transit or reported damaged
after they have left our unit.
Electrics.
Please note we sub-contract all our electric work to qualified electricians. In the event that we
cannot install then building on the day booked due to no fault of our own there will charges
applicable to come back and install the electrics, the original fee for the electrics will be non refundable. There will be a cancellation fee of £200 if the job is cancelled within 48 hours of
installation for electrics alone. Electric package prices do not include connection to your house, this
will need to be done by a qualified electrician at your own cost, or we can provide a quote.
Completion of order
Once the building has been completed, the customer or a representative MUST inspect the building
with our installation team. Should there be any issues with the installation, please make the
installers aware and note the delivery ticket prior to signing. If no notes are made, then we will
assume that the job is complete and deemed to have been finished to a satisfactory standard.
If no representative or customer is present on completion of the building, then this will be deemed
a breach of contract on behalf of the customer. In this instance once the job is complete, we will
deem it finished and completed to satisfactory standard and if there is any issues that may arise
from parts or functions that would normally have been checked and signed off by a customer, we
will not be liable and it will be the responsibility of the customer to sort out any issues with any
problems. Any call out after will subsequently be chargeable.
The team will take pictures of the completed building upon completion.
In the instance that your building is being delivered only, the customer must inspect each panel for
discrepancies so that these can be highlighted before the driver leaves.
We advise that the building is painted with a waterproofing paint as soon as possible and wherever
possible silicone sealing of all external panel jointing strips and corners is advised as belt and braces
against modern incremental weather.
Please note that all new buildings installed throughout the winter months will contain Timber that
has a higher moisture content than throughout the summer periods, this is normal especially if
buildings are installed in wet conditions. As the internal timber will dry before the external timber it
is not uncommon for wet patches to be identified internally. These are normal and to be expected, if
the issue persists after two weeks, please inform the Customer Relations team for inspection.

Faults, shortages or defects
If any parts are lost or damaged we will repair or replace damaged parts with new ones free of
charge. This is providing notification of such shortage or damage is made upon delivery or in writing
within seven days of delivery. Please contact us on info@noahgardenrooms.co.uk. We will always
request photos which clearly demonstrate any reported defect so we are able to determine the
cause prior to the possibility of rectification. If a defect does occur and clearly is the fault of Noah,
then we will give you suitable options which may include repair or partial refund (at the discretion of
management).
We cannot accept any claim for loss of earnings or consequential losses should a further visit be
required.
Our products and maintenance
Most of our buildings are designed so that planning permission is not required. Permission is the
responsibility of the customer and no liability to failed permission will be accepted by Noah Garden
Rooms.
We recommend that guttering be fitted to your building as soon as possible after installation to
avoid water ingress into the building. 1 ft of access is required around the building to allow our
teams to install your building and give you space to fit guttering and maintain your building. If our
team arrive and do not have a minimum of 12” of access around the building, there will be a
disclaimer to sign before installation can take place.
We would like to make it clear that our buildings are sold as garden rooms where
permissions/regulations are not required. You may wish to use your building for different
circumstances. If this is the case, we advise that should you choose to use your garden building for
specialist needs that you contact your local council / authority and discuss this with them.
Wood is a natural product and as such, may have inherent defects such as knots, splits and resin
pockets. These are simply aesthetic and will not affect the structure in any way. Wood filler may be
used if these items are noted prior to delivery.
We would like to remind customers that wood is an organic product, subject to naturally occurring
changes as a result from different environmental conditions. These changes include (but are not `
limited too) changes in colour, surface splits, cracks, warpage and shrinkage. The development and
appearance of these natural properties of timber are not defects with the product itself and as such
are not covered by Noah Garden Rooms. These are not seen as any reason for anyone to claim for
replacements, refunds or repairs. These natural changes can also lead to the profile of boards to
differ slightly. We supply cover strips to take the eye away from any areas where the profile of
boards may differ.
The number of panels used may vary from pictures on our website. This could be due to but not
limited to, the size of the building, the thickness in the cladding, the layout of the windows and
doors and the availability of certain timber lengths.
Wood filler may be required should the gaps appear due to the expansion and contraction of the
wood in differing weather conditions.
Door adjustments are not covered under our guarantee and may be required from time to time.
This is due to the expansion and contraction of the material in differing weather conditions and
seasons however these will settle over time.
Thermal movement may result in felt rippling, which although may not be aesthetically pleasing, it is
not considered to be a defect and any responsibility would not be accepted. If a felt issue occurs
more than three months after delivery we are not liable to re-attend however we may advise a
solution. In adverse weather conditions, felt may tear and the building may leak and we will not be
held liable for this and your 3 month warranty would be void. If ever there is a roof leak, it is our
procedure to seal the roof in the first instance. If you make any modifications to you building (i.e.
boarding and insulation), this will void your 3 month felt warranty.
Felt roofing is a standard option we provide for our buildings. In time, felt will deteriorate and will
need replacing. We recommend our EPDM rubber roof product for a long life roof covering option.
Some of our roof upgrades do come with an extended warranty. The corrugated roofing sheets,
metal sheets and EPDM rubber roofing all come with a 10-year warranty. This 10 year warranty
would be voided in the event of a storm.
The shingle roof option improves the aesthetical look of the building. However adverse weather
conditions can cause the tiles too loosen or come out of place. In this instance this is not covered by
any installation or product guarantee if weather is deemed to be the cause.
If you are in a high wind area, you may wish to consider upgrading to an EPDM rubber roof or
adding roof batons to the roof after installation.
We leave the eaves open to allow for ventilation. If you choose to block these off, you need to
consider ventilation to help prevent moisture inside the building. If the building is not being used
frequently, you may want to consider the use of vents should you choose to block off the eaves.
If you are considering doing boarding and insulation yourself after installation, we recommend that
you consider Tyvek (breathable waterproof membrane) and EPDM rubber roof upgrades. You will
also need to upgrade your roof supports to allow for the extra weight. The building should be
ventilated. If you are looking to board and insulate your garden room, please speak to our sales
team prior to purchase so that various upgrades can be discussed with you.
Any timber sizes that we show are Ex sizes. This means that it is the size of the material used prior
to it being processed and therefore the finish size will always be less than this size. Where any sizes
are given, they are approximations and in metric units. The characteristics of the timber will change
over time due to environment conditions. Please also note that this also refers to any CLS sizes
given. This is the size of the timber before machining and not the finish size of the product.
Depending on the base you use, there can be water splashing or water pooling under your building
which can soak into the floor (especially if your base is larger than the building you are having
installed). We recommend you put a damp-proof course down or seal around the bottom of your
building to stop water from coming up through the floor bearers in this instance.
All buildings should be aired out regularly to prevent any condensation or mould accumulating
inside the building. If mould does appear on the building, we will not be held liable.
We advise that the building is painted with a waterproofing paint as soon as possible.
If the painting option is taken or included with your building, we treat the building with a
waterproofing paint. As paint may be marked in transit, we will supply additional paint for touch ups
where required.
All our images and photography used are purely for illustrations purposes only. You must be aware
that all pictures that you may have seen to purchase are a variation of different styles and sizes that
have been requested and so these illustrations of pictures are not the actual sizes. The actual
product colours may vary due to the digital photography procedure; however, this will not in any
way undermine the overall quality or performance of our product.
We may also use photographs of your completed building for marketing purposes. Please let us
know via email if you do not agree to this.
Specifications are correct at the time of order but are subject to alterations or withdrawal at any
time without notice. As our policy is to constantly improve design, quality, and service, we reserve
the right to amend, alter or change at our discretion when such changes may be deemed desirable
or necessary. This will not affect your order or cost.
We’re always looking for ways to improve and develop policies and conduct. Because of this, we
reserve the right to alter our terms and conditions whenever necessary, without notice. This does
not affect your statutory rights.
10 Year Rot Guarantee
Our timber materials are pressure treated and tanalised with Tanalith E. The preservatives protect
the wood from attack by termites, other insects, fungal decay and rot for 10 years. The joinery
(Contemporary and Georgian) windows and doors are not pressure treated. If you choose the paint
option with us, we will treat the joinery with a wood preserver prior to painting in the colour of your
choice.
The guarantee does not cover splits or warping that can occur naturally over time.
In order to maintain the 10 year rot guarantee, you will need to ensure:-
• The building is assembled on a solid and level base from a suitable material;
• Regular maintenance of the building in terms of treatment against water ingress;
• Not modified in anyway which could affect the structural integrity of the building or cause
moisture ingress;
• The building must have been installed with 1 foot of clearance to allow for the ongoing treatment
and maintenance and as to not allow a build-up of moisture;
• Has not been in contact with an exterior wall or trees that may allow moisture to penetrate the
timber.
Force Majeure
Force majeure is defined as any cause to our buildings deemed beyond our control. This includes
(but is not limited to) act of God, War, Terrorism, Flood, Weather, Explosion, Natural catastrophes,
Civil/military disturbances, Strikes and theft. We will not be held liable or responsible for any failure
or delay in our terms and conditions if said cause is due to Force Majeure.
Additional costs
If you cancel the order after a deposit has been paid, there will be a fee charged between 10%
(nonrefundable deposit) and the full value of the building depending on when the order is cancelled.
(See cancellation period and fees).
If we are unable to deliver or erect any of our buildings, through no fault of our own, there will be a
charge for us to reattend. This fee is payable by the customer prior to any attempt to re-attend. The
reattend fee is dependent upon your building size and your distance from us. This fee can be
anything up to 50% of your total order value plus any additional mileage charges.
If you chose the fitting service and fail to provide either adequate access or an adequate base, then
the fitting charge will still stand and is non-refundable. There will be no discount if you choose to
subsequently put the building up yourself.
If you do not send two people to collect your building, we will charge £120 per person (inc. VAT)
required to load the building. This can only be offered if we have staff available to assist. If we do not
have staff available to assist, then you will be unable to collect the building on this date. The fee
would be payable within 15 minutes of the issue being raised
