Terms and conditions of the sale
Introduction
These Terms and Conditions (“Terms”) govern your use of the KJ Bownes website (www.kjbownes.com) and the purchase of any products through this site. KJ Bownes & Sons (referred to as “KJ Bownes”, “we”, “us”, or “our”) sells railway sleepers, rails, and related materials to customers within the United Kingdom and the Channel Islands. By accessing our website or placing an order, you (“the customer” or “you”) agree to be bound by these Terms. If you do not agree with any part of these Terms, you should refrain from using our site or ordering products. These Terms do not affect your statutory rights under UK law.
1. Product Description and Variability
We strive to describe and photograph products on our site as accurately as possible. However, due to the natural and reclaimed nature of many of our products (such as railway sleepers and used rails), variations in appearance, size, and condition will occur. All sizes, dimensions, and weights provided on the site are approximate.
Such variations are inherent to the character of the products and are to be expected by the customer. For example, reclaimed timber sleepers may exhibit differences in color or grain, weathering, knots, splits, nail holes, or other marks from previous use. These characteristics are part of the product’s character and do not constitute defects or grounds for return if the product is otherwise as described. Photographs on the website are for illustrative purposes only – the actual items you receive may vary in appearance due to their unique nature.
By purchasing from KJ Bownes, you acknowledge and accept that natural and reclaimed products will have variability. We make no guarantee that the product will be identical to any image or sample, only that it will meet the general description and specifications provided (allowing for reasonable variations as described above).
2. Returns and Delivery Charges
If you wish to return any goods to us (for example, if you change your mind), you are responsible for the cost of returning the items. Unless required by law, we will not refund the original delivery charge paid on your order. Once the returned goods are received and inspected, we will process a refund for the purchase price of the product (minus any delivery charges, if applicable). Goods must be returned in their original condition (unused and not damaged beyond what may have occurred from examining the product) to be eligible for a refund. We recommend using a tracked and insured delivery service for returns, as we cannot be responsible for items lost or damaged in return transit.
This returns policy does not affect your legal rights. If we have supplied an item incorrectly, or if a product is found to be faulty or not as described, please notify us as soon as possible. In such cases, we will work with you to arrange return or replacement at our expense, and we will refund any applicable delivery charges in line with your statutory rights.
3. Delivery Terms
Kerbside Delivery: Unless otherwise agreed in writing by KJ Bownes, all deliveries are “kerbside” only. This means the delivery driver will unload the goods at the nearest accessible point to your property (for example, at the curbside or the end of your driveway). The delivery personnel are not required to carry goods into your home, garden, or building site. It is your responsibility to ensure that you have the means to move the products from the kerbside to your desired location. Please ensure the delivery location is accessible for a large delivery vehicle; if there are any access restrictions (narrow lanes, weight limits, etc.), you must inform us in advance. Failure to do so may result in failed delivery attempts and additional charges.
Third-Party Carriers and Delivery Delays: We may use third-party freight or pallet network services (such as Palletline or similar pallet delivery companies) to deliver heavy or bulky goods. While we will provide you with an estimated delivery date, KJ Bownes cannot be held responsible for delivery delays once the goods are in transit with a third-party carrier. Delivery dates and times are estimates only and not guaranteed. Factors outside our control (such as traffic delays, vehicle breakdowns, or logistical issues in the courier network) may cause delays. Do not schedule any building, installation, or landscaping work dependent on the materials until you have received all goods in full and have checked them. KJ Bownes will not be liable for any costs, losses, or inconvenience caused by a delay in delivery, including (but not limited to) contractor fees or project delays.
If a delivery attempt is unsuccessful due to incorrect address information provided by you, or because you were not present or prepared to accept the delivery on the arranged date, you may be responsible for re-delivery charges. Title (ownership) and risk in the goods pass to you once the goods are delivered to the kerbside at your address (assuming payment has been received – see Payment Terms below). It is then your responsibility to promptly move and secure the goods. Please inspect the goods upon delivery and inform us of any damage or discrepancies as soon as possible.
4. Warranty Disclaimer
All products are sold by KJ Bownes “as is”, without any additional warranty, guarantee, or promise of specific performance. No warranty is offered with any products sold, to the fullest extent permitted by law. This means we do not provide any express warranties and we hereby exclude any implied warranties or conditions to the maximum extent allowed under applicable law.
In particular, we make no warranty that the products will be fit for any particular purpose not expressly stated by us, or that they will meet any specifications other than those outlined in the product description (subject to the Product Description and Variability clause above). Any information about the products provided by us (including any recommendations or technical guidance) is for general informational purposes and does not constitute a warranty of the product’s suitability for your specific situation.
Statutory Rights Unaffected: This Warranty Disclaimer does not affect any warranties or conditions that cannot be excluded or limited under law. Advance Payment and Withholding Delivery: KJ Bownes reserves the right to withhold or delay dispatch of any order until full payment has been received and cleared. If your payment is not successfully processed or is reversed for any reason (such as a chargeback or insufficient funds), we are under no obligation to fulfill your order or meet any originally quoted delivery date.
