1. Stock Description / Condition
1.1 If our stock is listed as ‘new with defects’ or ‘new - other’ or ‘used’, it may have cosmetic or functional defects, be for spares/repair, or good as new but have minor signs of use or testing. We make every effort to describe this via the item description and the photos. However, the photos best illustrate the most accurate description and condition of the item.
1.2 Please take note of Stock/Actual photo variances as well as Stock Description and Condition variances. Below is a summary of these:
Stock Photo – The image(s) of an item as sold when new and unused.
Actual Photo – The image(s) of the item that is for sale. The image(s) will highlight any defects. If there are variances between the Stock photo and Actual photo, the Actual photo is what is on offer. Any accessories not shown in the Actual photo are not included. If you have any questions, please ask before committing to a bid/order.
Stock Description – This is the manufacturers description of the product as it would be when sold as new. This may include a generic description, variants or measurements which may not apply to the actual item for sale. Please refer to the Condition field and Actual photos for specifics and detail of the item on offer.
Condition – This will highlight any defects or conditions that deem the item’s state. It may include minor/major defects, functional or cosmetic. This is a guidance and should be used in conjunction with the actual photo’s to best gauge the condition of the item on offer.
2. Payment
2.1 Goods are available for resale until payment is made, so prompt payment is encouraged to avoid loss of the item. Our standard process is to allow 2 days for payment. At this point an Unpaid Item Reminder will be sent. If payment is not made 2 days of this, the item may be relisted and the sale cancelled. We reserve the right relist any items unpaid within the above time frames.
2.2 When payment is made, this must be started through eBay as it will then change the order status to paid. If a direct payment is made into PayPal, this may cause a delay in an order being processed and therefore is not preferred. Goods are available for resale until payment is made, so prompt payment is encouraged to avoid loss of the item.
2.3 In the event we are unable to supply the goods purchased, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.
2.4 All prices are shown in £s sterling and include VAT (where applicable) at the applicable current rates but exclude delivery charges, unless expressly stated otherwise.
3. Shipping
3.1 By default, we ship within the UK but please refer to each individual listing which may have overseas shipping options.
3.2 We only ship to the address selected when the order is placed. If there are changes to this, we ask buyers to change the shipping address when placing an order.
3.3 We do not offer collection from our facility.
4. Returns, Warranty, Cancellations and Substitutions
4.1 We offer a 14-day return policy if a buyer changes their mind. The return postage costs need to be paid by the buyer; however, a full refund including original shipping costs will be processed upon receipt and inspection of the item.
4.2 At times, product specifications from the manufacturer may change, in which case we will do our best to offer a similar alternative.
4.3 We may experience problems with the supply of certain products and may therefore supply a substitute of the same or better quality at the same price.
4.4 There is no warranty given on any of our items.
4.5 Where applicable, you may cancel your order in accordance with your rights under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations.
4.6 All sizes and measurements are approximate, but we do try to make sure that they are as accurate as possible.
5. Liability and Indemnity
5.1 Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.
5.2 The Bike Outlet will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any:
economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or
loss of goodwill or reputation; or
loss of privacy and loss of data; or
special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.
5.3 Notwithstanding the above, for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.
5.4 This clause does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.
5.5 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
6. Other Provisions
6.1 The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.
6.2 We have selected our products on the basis that they will be used for domestic use only, if you are planning to use them for business purposes please make sure that you are covered by the appropriate insurance. Where you decide to use the products in the course of a business, we exclude (to the fullest extent permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the products shall be limited to the replacement value of the product in question (except in the case of death or personal injury caused by our negligence or in respect of fraud). In relation to business users, we do not accept liability for the fitness of goods for business purposes, nor do we accept liability for loss of use of the item nor any loss over and above the cost of the item in the event of a claim for breach of warranty or condition.
6.3 We shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.
