Terms and Conditions
General
1.1 Buy and Drop (UK) Ltd (also referred to as “we” or “us”) deals with both consumers and business purchasers. Certain terms and conditions apply only to consumers, while others apply only to business purchasers. These distinctions will always be clearly stated. If you are a consumer, nothing in these terms and conditions adversely affects or limits your statutory rights.
1.2 We only contract with customers based on these terms and conditions, and we specifically reject any alternative terms and conditions proposed by prospective purchasers, especially those conflicting with ours.
2. The Contract Between Us
2.1 No contract is formed until we receive irrevocable payment for the goods you order.
2.2 A legally binding contract is made between us:
2.2.1 If payment is made by credit or debit card, only when the payment for the full price of the goods has been irrevocably processed.
2.2.2 If payment is made by any other means, only when the full price of the goods has cleared into a bank account of Buy and Drop (UK) Ltd.
3. Price
3.1 The prices payable for goods you order are as set out on our website or any written quotation we send to you.
3.2 As noted in paragraph 2 above, no legally binding contract is made until we receive irrevocable payment for the goods. Pricing on the website is subject to change without prior notice, and our suppliers may change their pricing before we are contractually obliged to supply you at any particular price. If that happens, we will contact you to discuss the price revision and give you the chance to reconsider your purchase.
3.3 All goods supplied within the United Kingdom (UK) or European Union (EU) are subject to VAT at the current rate at the time of supply. Orders outside the UK and EU are VAT-free.
4. Right for You to Cancel Your Contract
4.1 If you are a “consumer” (but not otherwise), you may cancel your contract with us for the goods you order at any time up to the end of the 30th day from the date you receive the ordered goods. You do not need to give us any reason for cancelling your contract, but there is a minimum charge of 20% plus delivery/collection charge as we can no longer sell the item as new. This is based on the condition of the item(s) received at our premises upon your return. This does not apply to Special Order products – see clause 4.6. Customers are advised to clearly photograph any freight returned as damages in transit are at your risk. Due to the personal nature of the goods we sell, any refund will be considered as a store credit to be used against future purchases.
4.1.1 After 30 days from the purchase date, we shall be entitled to repair the product where possible prior to issuing a refund credit note.
4.2 To cancel your contract under this clause 4, you must notify us in writing.
4.3 If the goods have been despatched to you before you cancel your contract, you must send the goods back to Buy and Drop (UK) Ltd, 60 Sunderland Road, Sandy, Bedfordshire, SG19 1QY, at your own cost and risk as soon as possible. If you are unable to arrange the return, Buy and Drop (UK) Ltd will arrange a collection at your cost. Payment for collection must be made at the time you request the collection. If the return is due to a faulty product, the cost of return will be reimbursed. If you return the goods by your own means, any reasonable charge will be refunded in the same circumstances.
4.4 Once you have notified us of your cancellation under this clause, any sum debited from your credit or debit card will be credited to your account as soon as possible and within 14 days of our agreement to your refund, provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods and any other losses from the amount to be credited to you.
4.5 Special Orders or Made to Order items cannot be cancelled once accepted by us. Once the order is placed, we contact the manufacturers to arrange delivery, and the order cannot be cancelled, returned, or refunded for any reason.
4.6 In accordance with transport legislation, damage related to transport must be declared to us within 48 hours after observation via email. Failure to do this can lead to your warranty becoming invalid, and any claims may be refused.
5. Cancellation by Us
5.1 We reserve the right to cancel the contract between us for any reason, including availability, pricing, delivery location, or if one or more of the goods ordered were listed at an incorrect price due to a typographical error or an error in the pricing information received from our suppliers.
5.2 If we cancel your contract, we will notify you by email and credit any sum deducted from your credit card within 14 days of your order. We will not offer any additional compensation for disappointment suffered.
6. Delivery of Goods to You
6.1 There is a £7.95 delivery charge to the majority of UK mainland addresses on orders under £139 inc VAT. Some postcodes incur greater shipping charges, calculated at checkout. Shipping charges applied to the order are non-refundable unless the machine is returned with an agreed warranty fault.
6.2 Orders for delivery outside the UK mainland or commercially viable UK mainland locations will not be processed until we have contacted you to agree on additional shipping charges.
6.3 Delivery times quoted on the website are:
6.3.1 In working days.
6.3.2 An estimate only and not a term or condition of the contract with us. We will endeavour to advise you of any anticipated delay.
6.4 You will become the owner of the goods when they are delivered to you. Once delivered, the goods will be at your risk, and we will not be liable for their loss or destruction. If you request delivery to a freight forwarding agent for onward transport, you will become the owner of the goods, and they will be at your risk when delivered to the freight forwarding agent.
6.5 You must comply with all applicable regulations and legislation, including obtaining all necessary customs, import, or other permits to purchase goods from our site. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
6.6 We recommend keeping the product packaging/pallet even once assembled in case you need to return the product later. We are unable to supply replacement packaging.
6.7 We warrant goods via the Manufacturer in line with their Terms and Conditions. Warranty is non-transferable and lies with the original purchaser. Commercial warranty terms differ from those for domestic consumers.
6.8 Spectrum petrol lawnmower warranty (TG range). These products carry a 5-year limited warranty. For the first 2 years, we will cover the cost of repairing your machine, including spare parts, where the fault is due to faulty parts, workmanship, or manufacture. For 5 years, we will cover spare parts on the same basis as the first 2 years. During your period of ownership, you are expected to keep your machine well-maintained, cleaned, lubricated, and serviced as needed. Any misuse, neglect, accidental damage, or loss is not covered under this warranty, but we will always endeavour to help you with problems outside our warranty.
7. Liability
7.1 If you are a consumer, then clauses 7.4 to 7.6 do not apply to our contract.
7.2 Nothing in this clause 7 or these terms and conditions generally is intended to exclude or limit our liability for any death or personal injury resulting from our negligence.
7.3 We will always use reasonable endeavours to ensure that you benefit from whatever manufacturer’s guarantee is provided with the goods you purchase.
7.4 If the goods we deliver are not what you ordered, are damaged or defective, or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address within 5 working days of the delivery of the goods in question.
7.5 If you notify a problem to us under clause 7.4 above, our only obligation will be, at your option:
7.5.1 To make good any shortage or non-delivery.
7.5.2 To replace or repair any goods that are damaged or defective.
7.5.3 To refund you the amount paid for the goods in question in whatever way we choose. Under no circumstances will we be liable for any costs you incur in recovering any such refund. Any tangible items returned must be at our discretion.
7.6 We will not be liable for any indirect or consequential loss, damage, or expenses (including loss of profits, business, or goodwill) arising out of any problem you notify us under this condition. We shall have no liability to pay any money to you by way of compensation other than to refund you the amount paid for the goods in question under clause 7.5.3 above.
7.7 If you need to return the goods for any reason, it is your responsibility to send the product(s) back to Buy and Drop (UK) Ltd, 60 Sunderland Road, Sandy, Bedfordshire, SG19 1QY. We will not accept a return without packaging (see clause 6.6).
7.8 It is your responsibility to ensure the package is adequately packed. Any damage to the contents will be the sender s responsibility and may incur charges or deductions from any refund. To minimise the risk of damage or charges, we suggest contacting a local garden machinery agent for inspection/repair.
