Official Rules – eBay For Charity Prize Draw
Promotion Organiser
The organiser of the eBay For Charity Prize Draw(“Promotion”) is eBay International AG, Helvetiastraße 15-17, 3005 Bern, Switzerland, www.ebay.co.uk (hereinafter, "eBay" or "we"). eBay may carry out the promotion through its local subsidiaries.
Our cooperation partner Tenthwave Digital LLC, 35 Pinelawn Road, Suite 207W, Melville, NY 11747 (hereinafter, "Tenthwave") handles the technical side of the Competition and is responsible for the notification of winners and sending the prizes.Eligibility
All residents of the United Kingdom who are 18 years of age or older at the time of entry, and who are registered members of www.ebay.co.uk at the time of entry are eligible. Employees (and their families) of eBay, affiliates, subsidiary companies, representatives or agents of those companies and anyone else who may have be professionally involved with the Promotion are not eligible to enter.
Please note you must have a valid PayPal account to be eligible to receive a prize. Promotion Period
The Promotion begins at 00:00:01 BST on 1 September 2013 and ends 23:59:59 BST on 30 September 2013 (the "Promotion Period").
The Promotion consists of one free prize draw at the end of the Promotion Period (the “Prize Draw”).Entry Procedure
In order to enter the Prize Draw, you must do the following:
- Sign into www.ebay.co.uk during the Promotion Period;
- Thereafter, you will receive one entry in the Prize Draw if you do either one of the following: (1) Sell an item via eBay for Charity, with at least 10% donated to a charity of your choice; or (2) Donate to a charity at eBay checkout to either a featured charity or your pre-selected favourite charity.
For the avoidance of doubt, the Prize Draw is limited to one entry per eBay user ID during the Promotion Period.
Alternative Free Method of Entry:
To enter the Prize Draw by postal mail, print your name, address, town, county, post code, eBay user ID, date of birth, email address (optional), and daytime telephone number and the words eBay for Charity Prize Draw on a card and post it, in an envelope with postage affixed, to: Tenthwave Digital at Dalton House, 60 Windsor Avenue, London SW19 2RR. Postal entries must be postmarked by 30th September 2013 and received by 7th October 2013 in order to be eligible. Limit one entry per eBay user ID.
PLEASE NOTE: NO PURCHASE IS NECESSARY FOR ENTRY INTO THE PRIZE DRAW. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Opt-out of entry
You will be automatically entered into the Prize Draw. If you do not wish to be entered into the Prize Draw, please send an email to ebayforcharity@tenthwave.com which contains: a) the words "Opt-out of the Prize Draw" in the subject box; b) your eBay user ID; and c) your request to opt out of the Prize Draw.Prizes
All prizes are subject to verification of eligibility and compliance with the terms of these Official Rules.
Five (5) winners will be selected in a random drawing after the end of the Promotion Period from among all eligible entries received during the Promotion Period. Each winner will receive £500 to be awarded as a deposit to his/her PayPal account (each a “Prize”), which will be handled by Tenthwave. In addition, PayPal Giving Fund will award £1,000 as a deposit to the bank account of the charity that each winner chooses from among any UK registered charity. In order to receive the £1,000 deposit, a charity must be registered as a member of PayPal Giving Fund, which administers eBay for Charity. If charity is not a member of PayPal Giving Fund upon prize notification, they have fourteen (14) days from winner notification date to register in order to receive the £1,000 deposit.
All taxes and any other costs not specifically stated within these Official Rules are the sole responsibility of the winners.
Prizes are not transferable and no substitutions or cash equivalents are permitted, except that which eBay at its sole discretion, may substitute the prize with a prize of equal or greater value. Specifics of the prizes are in eBay’s sole discretion.Awarding of Prizes & Prize Notification
Five (5) Prize winners will be selected in a random drawing on or about 14 October 2013 from among all eligible entries received during the Promotion Period. The random drawing will be conducted by Tenthwave. The Prize winners will be notified by electronic mail and/or overnight or postal mail on or about 18 October 2013. eBay’s decisions are final and binding on all matters relating to this Promotion.
Prize funds to be awarded will be credited to the winners’ PayPal accounts. Prize winners must have or must create a PayPal account, in good standing, in order to receive, access, and use the prize. If you are an existing PayPal customer, your prize will be deposited in the PayPal account associated with the email address you provided. If the email address you provided is not associated with your PayPal account, you must associate it with your PayPal account within ten (10) days from time of prize notification. If you do not currently have a PayPal account, you must create a PayPal account within ten (10) days from the time of prize notification to qualify. It is your sole responsibility to keep your eBay account in good order with correct and up-to-date details in order to be awarded a Prize. Exclusion from Participation
Any attempt to manipulate the Prize Draw is prohibited and will result in exclusion from participation.
Any entries that have been generated by a script, macro, bot or any other automated means will be deemed void. Entries that are mechanically reproduced, copied, illegible, incomplete, postage due or inaccurate are void. Entries made through the use of any agent or other device or artifice to enter multiple times in a day will be deemed invalid. Incomplete entries not complying with these Official Rules are subject to disqualification and will be deemed void.
You will not be eligible for the Promotion if your accounts on any eBay site are not in good standing. In order for your accounts to be deemed in good standing your account must not be suspended or any payments are past their due date during or after the Promotion Period. In addition, you will not be eligible for the Promotion if your PayPal account is or becomes locked, closed or restricted during or shortly after the Promotion Period.
If eBay has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants.
eBay reserves the right to disqualify participants who do not comply with these Official Rules or with the eBay User Agreement and/or any other eBay policies. Limitation of liability
eBay makes no representations or warranties of any kind regarding any product or service provided by any third party in connection with the Promotion.
eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Promotion. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.
eBay will not be responsible for any third party's performance or failure to perform any services related to the Promotion, or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Promotion, provided that nothing shall limit eBay's liability for death or personal injury caused by its negligence.
eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Promotion.
Although eBay will use reasonable efforts to ensure that all information relating to the Promotion ("Promotion Material") is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the Promotion or the site, including without limitation the accuracy of any Promotion Material. eBay reserves the right to suspend, change or cancel this Promotion at any time, in the event of circumstances arising which in eBay's opinion make it necessary for it to do so. eBay reserves the right to add additional terms and conditions for certain parts of this Promotion.

Entrants agree that the conditions of submission set forth in these Official Rules, and all documents and agreements incorporated in these Official Rules by reference, solely govern the relationship between entrants and eBay in connection with this Promotion.
By participating, Eligible Participants agree to be bound by these Official Rules including all eligibility requirements. Use of any eBay Site and eBay’s use of information submitted by entrants in connection with this Promotion will be subject to the terms and conditions stated in these Official rules as well as to the eBay User Agreement and Privacy Policy.
These Official Rules are governed by the law of England and Wales. Each party irrevocably agrees to the exclusive jurisdiction of the English courts over any claim or matter arising under these Official Rules.
